NORMATIVE–LEGAL ANALYSIS OF THE PROTOCOL OF COOPERATION BETWEEN THE PPO AND THE MoI OF THE REPUBLIC OF NORTH MACEDONIA

Abstract

Introduction: This paper provides a legal analysis of the provisions contained in the recently adopted Protocol of Cooperation between the Ministry of Interior (MoI) and the Public Prosecutor’s Office of the Republic of North Macedonia (PPO) within the framework of criminal procedure. 

Methods: The paper conducts a comprehensive legal analysis of  legislation within the relevant legal field and also the Protocol’s provisions, while also examining specific internal legal acts established between the two institutions.

Results: The analysis demonstrated that the Protocol contains certain ambiguities in the legislative text that need to be more precisely defined.

Discussion: By adopting the new Protocol, and considering the challenges faced in the past two years, both institutions have undertaken a substantial step towards overcoming divergences in their joint actions, with the overarching aim of ensuring that justice in the Republic of North Macedonia is administered at the highest possible standard.
